United States v. Roske, No. 8:22-cr-00209-DLB, District of Maryland. The indictment charged an attempt to assassinate a Justice of the United States, 18 U.S.C. § 351(c). The docket was filed June 15, 2022. Nicholas John Roske pleaded guilty in April 2025 without a plea agreement.

On October 3, 2025, in Greenbelt, Judge Boardman sentenced Roske to 97 months — eight years and one month — and a lifetime of supervised release. The Department of Justice public statement the same day said the Department had advocated for a sentence of at least 30 years to life. Attorney General Pamela Bondi called the sentence “woefully insufficient” and said the Department would appeal. Those are the Department’s words. They are not a Fourth Circuit holding.

H.Res. 818 later recites that sentence as its exhibit and quotes Boardman: “I take into consideration the conditions of pre-trial confinement and the fact that she is a transgender woman.” The resolution is a House filing.
